酒駕過失殺人(manslaughter) 是首犯的話
檢察官會根據肇事者背景跟事發當下的狀況決定起訴項目
最低可以是一年以下有期徒刑的微罪（misdemeanor）
然後也有可能會被視為犯罪（felony ）
刑期最高十年

這個則是十五年以上有期徒刑
當然這只是起訴
會不會被判刑也要看身分就是了

不要以為國外就判很重
