escroe大部分討論的都是球員補償給聯盟，今天介紹一個比較特殊的 還有一些關於escroe的補充

根據Article 39 Section 8

Article XXXIX Term of Agreement
Section 8. Shortfall Payment; Escrow Refunds.

(a) If, at the conclusion of a Salary Cap Year, the total Basketball Related Income (BRI) Reported to the Players Association for that Salary Cap Year results in players having received less than the agreed percentage share (50% or other agreed percentage) of total BRI, the NBA shall pay the players the amount required to eliminate the shortfall (the “Shortfall Payment”).

(b) The Shortfall Payment shall be made within thirty (30) days after the completion of the annual BRI audit report or audit report challenge period, whichever is later, and shall not count toward any team salary or salary cap calculations.

(c) Notwithstanding any escrow withholding provisions, if the amount withheld in escrow exceeds the Shortfall Payment due to the players, the excess escrow funds shall be refunded to the players in accordance with the procedures set forth in Article VII Section 12 (Escrow).

(d) If the parties disagree on the calculation or distribution of a Shortfall Payment or escrow refund, the dispute shall be resolved by the System Arbitrator as provided in Article XXXI (Dispute Resolution).

第8節 短缺補足款與托管退款

(a) 若在某薪資帳單年度結束時，根據提交給球員協會的BRI報告顯示，球員實際分得的金額不足預定比例（50% 或其他約定比例），NBA 必須支付相應金額以補足差額（「短缺補足款 Shortfall Payment」）。

(b) 短缺補足款應於年度 BRI 審計報告完成或審計申訴期結束後 30 天內支付，並且不計入任何球隊薪資或薪資帽計算。

(c) 儘管有 escrow 預扣規定，如果 escrow 預扣金額超過應補足款，超出部分應依據第七條第12節（關於 Escrow）程序退還給球員。

(d) 若在短缺補足款或 escrow 退款的計算或分配上發生爭議，應依照第 XXXI 條（爭議解決）由系統仲裁人裁決。

也就是如果球員少拿，將由聯盟補足

聯盟並不是直接給球員錢，而是給球員公會

但球員工會並沒有將分配方案公開，但可以看到一些時任委員或會長的公開討論

包含

1.部分金額將歸入球員的退休金

2.定額發放+依合約比例發放(例如其中的50%按照有合約的人數發放 ;剩餘的部分再按照合約大小依比例發放)

3.將沒有正式合約的球員與G聯盟納入考慮

(以上都是指將球員的escrow退給球員之後，聯盟還超額創收的情況)

順便一提，escrow是開季前聯盟與球員工會約定的比例，並不是固定10%，可以是14%也可以是最多的25%(疫情年)

因為球員在escrow不夠的情況，也不需要超額補償球團

但如果反過來escrow不夠補償球員，聯盟必須要支付球員報酬直到50%
