(2)A person may not be appointed as Secretary of Defense—
(A)within seven years after relief from active duty as a commissioned officerof a regular component of an armed force in a grade below O–7; or
(B)within 10 years after relief from active duty as a commissioned officer ofa regular component of an armed force in the grade of O–7 or above.

如果是淮將以下退要當7年老百姓才有資格 如果是淮將以上則要10年

如果美國總統真的很想要突破這個規則 那要求國會給予赦免

也因此美國國防部部長大部分是文人擔任
